References herein to “Sitel Associates” or to “our associates” refer to employees of affiliates of SITEL Worldwide Corporation.
Sitel Worldwide Corporation (“Sitel”) posts on its website in its Resource Library certain documents, reports and podcasts that might be of interest to you, including white papers, press releases and other publications (collectively, “Documents”). Choice of Law and Venue
These Terms and Conditions are entered into in the State of Tennessee and shall be governed by and construed in accordance with the laws of the State of Tennessee, without reference to or application of its conflicts of laws rules or principles. Each party to these Terms and Conditions submits to the exclusive jurisdiction of the state and federal courts sitting in Davidson County, Tennessee, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. In any action to enforce these Terms and Conditions, the prevailing party will be entitled to costs and attorneys fees. In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
These Terms and Conditions constitute the entire agreement between Sitel and you pertaining to this website. In its sole discretion, Sitel may from time-to-time revise these Terms and Conditions by updating this posting. Sitel and its affiliates (collectively “Sitel”) are committed to protecting the privacy of those who entrust us with their personal data. Sitel respects individual privacy and values the confidence of our clients, employees and others. Sitel adheres to the Safe Harbor Agreement concerning the transfer of personal data from the European Economic Area (which includes the member states of the European Union) (the “EEA”) to the United States of America as well as other laws and regulations applicable to the transfer of data. Accordingly, we follow the Safe Harbor Principles published by the U.S. Department of Commerce (“Principles”) with respect to all such data.
Sitel has certified its adherence to the Safe Harbor Agreement with respect to personal data processed as part of its business and human resources activities and any other personal data that maybe transferred on behalf of its clients. Sitel’s Safe Harbor Certification can be found at www.export.gov/safeharbor.
Accordingly, Sitel adheres to the following Safe Harbor Privacy Principles, as agreed to by the U.S. Department of Commerce and the European Commission.
The following terms are used throughout this document and defined here for clarification.
Agent: “Agent” means a third party that processes personal data solely on behalf of and under the instructions of Sitel.
Personal Data: “Personal data” means any data or set of data that (i) identifies or can reasonably be used to identify an individual, directly or indirectly, and (ii) in particular by reference to an identification number or to one or more factors specific to physical, physiological, mental, economic, cultural or social identity.
Sensitive Data: “Sensitive data” means any personal data that reveals race, ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that concerns health or sex life. Data will be treated as sensitive personal data where it is received from a third party that treats and identifies it as sensitive.
Notice: Sitel will inform individuals about the purposes for which we collect and use personal data about them, how to contact us, the types of non-agent third parties with whom we may share personal data, and any ways that individuals may limit the use and sharing of such data. This notice will be provided when individuals are first asked to provide personal data or as soon thereafter as is practicable.
Choice: Sitel will offer an individual the opportunity to choose (opt out) whether personal data is (a) shared with a non-agent third party or (b) used for a purpose other than that for which the data were originally collected or subsequently authorized by the individual.

Access: Sitel will provide individuals with reasonable access to personal data about them and they may request the correction or amendment of personal data that they demonstrate to be incorrect or incomplete.
Onward Transfers to Agents: Sitel will only transfer personal data to an agent where Sitel has first ascertained that (i) the agent subscribes to these Principles or is subject to the European Commission’s Directive on Data Protection or another adequacy finding, or (ii) has obtained assurances from the agent by written agreement that it provides at least the same level of privacy protection as is required by these Principles. Where we have knowledge that an agent is using or sharing personal data in a way that is contrary to these Principles, Sitel will take reasonable steps to prevent or stop such processing.
Onward Transfer to Non-Agents: Sitel will only transfer personal data to a non-agent third party where consistent with the notice and choice Principles stated above.
Integrity: Sitel will only use and share personal data about individuals in a way that is consistent with the purposes for which the data were collected or subsequently authorized by those individuals. To the extent necessary for those purposes, Sitel will take reasonable steps to ensure that the data are accurate, complete, and current.
Information Security: Sitel will take reasonable precautions to protect personal data from loss, misuse and unauthorized access, disclosure, alteration and destruction.
Enforcement: Sitel has put in place mechanisms to verify our ongoing adherence to these Principles. We encourage individuals covered by this Policy to raise any concerns that they have about the way that we process their personal data by contacting us at the address below, and we will do our best to resolve them. We have also agreed to participate in the dispute resolution program provided by the European Data Protection Authorities Panel.
Limitation on Scope of Principles
Adherence by Sitel to these Principles may be limited to the extent required to meet legal, governmental, national security, or public interest obligations.
